Judge Rules "Don't Ask, Don't Tell" Unconstitutional

In October of 2004, the Log Cabin Republicans filed suit challenging the constitutionality of ‘Don’t Ask, Don’t Tell, ‘ the law that prohibits the service of openly gay, lesbian, and bisexual service members. 

On September 9, 2010, U.S. District Judge Virginia Phillips ruled that ‘Don’t Ask, Don’t Tell’ violates the First Amendment free speech and Fifth Amendment due process rights rights of gays and lesbians. 

Our speaker, Professor Embser-Herbert, was one of seven expert witnesses called by the Log Cabin Republicans. Hear what she has to say about this landmark case.
